In order to bring any type of personal injury claim in Ireland, one must follow the Personal Injury Process in Ireland as laid out by the Personal Injury Assessment Board Act (PIAB).
Road Traffic Accidents/Motor Accidents
If you have been involved in a road traffic accident (RTA) and have suffered for example whiplash, back and spinal injury you may be entitled to make a personal injury compensation claim for injury and losses (loss of earnings, medical bills etc.) if the accident was caused by another person who breached another road user’s duty of care.
If the accident involved a so-called ‘Hit and Run’ driver or an Uninsured driver, we will advise you to make a personal injury compensation claim to the Motor Insurer’s Bureau of Ireland (MIBI). The function of the MIBI is to compensate victims of road traffic and car accidents caused by uninsured and unidentified vehicles.
Workplace Accidents

Accidents in Public Places

Medical Negligence Claims
Medical negligence has a broad meaning insofar as it can cover a very broad spectrum of problems arising out of lack of adequate clinical care. It may arise out of a lack of duty of care by a doctor, surgeon, nurse, dentist, or mid-wife etc. In essence, medical negligence relates to all health professionals practicing and caring for patients.
All medical professionals owe a duty of care to their patients and if they have acted in a manner which is below a reasonable standard then this duty is deemed to have been breached.
Medical Negligence Claims are somewhat different to other personal injury claims in that the PIAB process does not apply to these types of claims. The PIAB cannot deal with jurisdiction in respect of medical negligence claims. In order to bring a medical negligence claim one would have to issue court proceedings from the outset.
Garda Compensation Claims
Under the Garda Compensation Act 1941-1945 (as amended), if you are member of An Garda Síochana and have suffered an injury during the course of your duties, you may be entitled to compensation.

You should note that time limits apply to the bringing of claims under the Garda Compensation Act 1941-1945 (as amended) and a claim must be lodged within three months of the date of the incident, this in essence begins the process. However, in certain circumstances, the Minister has discretion to grant an extension of time. We suggest to make the application within the three month period in order to assist you in bringing a claim.
